In 75% of the 375 wrongful convictions overturned by DNA evidence in the United States between 1989 and 2023, eyewitness misidentification played a central role. The figure, documented by the Innocence Project, is not a statistical anomaly — it is a structural problem rooted in how memory actually works. The brain does not store experience the way a hard drive stores data. Each act of retrieval is also an act of reconstruction, and reconstruction introduces distortion.
